Below are the documents for buying or selin g a property in Turkey. Items 1 and 2 are not legally required for the deeds processing in the Tapu but are for your protection and peace of mind:
1) --- Written Contract
This is a contract between the parties to declare the intention to buy/sell a property together with the conditions agreed
2)--- Sale Agreement
From the public notary.Relevant situations which the sale can not be completed immidiately due to military authority approvals.İt is recomended that this agreement should be registered in the Land Registry Office (Tapu Sicil Md.)
3)--- Letter of Attorney
a)--- Seller
In order to sell the property, it should be given to a third party preferably Turkish- who can be a lawyer or estate agent.
b)--- Buyer
In order to buy the property, it should be given to a third party preferably Turkish- who can be a lawyer or estate agent
4)--- Passport Translation
5)--- Tax Number
6)--- Land Registry
The documents listed below should be presented to the Land Registry Office (Tapu Sicil Md.) for both parties
a)--- 8 passport size photos
b)--- Passport photocopy
c)--- Tax no.
d)--- Photocopy of the deeds of the property
e)--- letter of authorisation describing the property as a home or workplace from the Municipality (Belediye) or District
Office (Valilik)
f)--- Building permit for the immovable
These will be calculated according to the buying price of the property
The prices below are a guide only and are subject to change.
1)--- Estate Agent's commission.That should be clearly stated by the agent and an agreement should be signed.
2)--- Translation fees (generally 60ytl/document)
3)--- Sales Agreement (200ytl pus 7.5% of the sale price)
4)--- For registration of the agreement to the Land Registry (tapu) 65ytl plus 4.5% of the sale price.
5)--- Land registry fee 60ytl plus 3%of the sale price.
6)--- Letter of Attorney (for buyer)
7)--- Letter of Attorney (for seller)
8)--- The map fee and application fee for the for the Aegean Military Command
9)--- Solicitor's fee
Unless it is agreeed otherwise, the registry and notary fees are shared equally between the buyer and seller.
